Background
Since July 1, 2008, the vendor of a residence or apartment whose electrical system dating back to before October 1, 1981, must submit an inspection report of the electrical installation to the notary.
The change of the EU Directive (see previous reference) has also made it mandatory to submit an Energy Performance Certificate when selling or renting residences, apartments, studios and the like.
The moment a residence is offered for sale or rent, an Energy Performance Certificate must be available. The Energy Performance Certificate is handed over to the purchasing party at the time of sale. As a matter of fact, the deed also includes a clause on this.
Tenants must receive a copy of the Energy Performance Certificate.
The Energy Performance Certificate shall inform potential buyers or tenants about the energy performance of the building by assigning it with a score or an energy label.The Energy
Performance Certificate also contains a range of energy saving recommendations.
An Energy Performance Certificate can only be prepared by a certified energy expert. However, an electrical inspection may only be performed by a certified inspection body.
In order to save time and money it is recommended that the two inspections are carried out in one visit.
